To save environment and to protect wild as well as other animals, species, flora and fauna government of India enacted The Indian Forest Act, 1927 its applies to the whole India. Under this statue either Central government or State government may issue notification to declare any territory as forest and even state government is also having authority to issue such notification e.g. in state of Maharashtra government enacted Maharashtra Private Forest Act, 1975

After the issue of a notification under section 4, of Indian Forest Act no right shall be acquired in or over the land comprised in such notification, except by succession or under a grant or contract in writing made or entered into by or on behalf of the Government.

Under section 3 of Maharashtra Private Forest Act, 1975 all private forest in state shall stand acquire, vest and free from all encumbrances in and shall be deemed to be with all rights in or over the same or appertaining thereto the property of the state government. All forest vested in the state government under in this shall be deemed to be reserved forest within the meaning of Indian Forest Act.
