Enacted by the central government for the welfare of old parents and senior citizens. Senior citizens in India face many problems, including health issues, economic insecurity, elder abuse and social isolation. Day by day problems of senior citizens are increasing all over India even children are not ready to maintain their own parents and therefore government of India enacted THE MAINTENANCE AND WELFARE OF PARENTS AND SENIOR CITIZENS ACT, 2007 and its provisions as well as procedure is as follows:-
- Maintenance Tribunal – Every state government has to establish tribunal to entertain application under this act however state government of Maharashtra has appointed District Collector to dispose of such application and District Collector has delegated his power to Sub-Divisional Officer (SDO), in some district even Tahsildar can dispose of application under this act.
- Appeal – Aggrieved party can file appeal before Appellate Tribunal i.e. in case of Tahsildar order to Sub-Divisional Office so on.
- Procedure – Old parents or any senior citizens can file application before appropriate officer for demanding maintenance from their children or persons mentioned in the said act, after that officer responsible for disposal of application will give notice to Chinden to be present before him.
- Content of Application – Must state categorically about negligence by children, amount required, medical conditions etc.
- Disposal of Application – should be within time limit and officer can order to pay maximum Rs. 10,000/- per month maintenance.
- In case of non-obedience of his order he can order to penalty.
